User eligibility and Site accessibility
By accessing the Site, the user (hereinafter, the “User”) acknowledges having read and accepted these Terms of Use of the Site and agrees to comply with them. If not accepted, the User is invited to stop browsing the Site.
Château Montrose reserves the right to modify these Terms of Use at any time, in order to take into account any technological, commercial or legal developments, and therefore invites its Users to consult them regularly, the date indicated at the top of these Terms of Use indicating their latest update.
To browse the Site, the User must be legally authorized to consume or purchase alcohol in their country of residence.
Château Montrose also reserves the right to deny access to the Site to any User who has previously made, or would make, fraudulent use of the Site. The Site is accessible to Users at all times. However, an interruption for technical maintenance may be decided, in which case Château Montrose will make its best efforts to communicate
2. Site content
The purpose of the Site is to provide information regarding all activities of Château Montrose. All information provided on the Site is given for informational purposes only and is subject to updates or modifications. Château Montrose cannot guarantee the completeness of the information. Although Château Montrose strives to provide as accurate information as possible on the Site, it cannot be held liable for omissions, inaccuracies or failure to update, whether caused by itself or by third-party partners providing such information.
3. Intellectual property rights
Intellectual property rights, including but not limited to trademarks, images, graphics, designs, logos, texts, sounds and software making up and/or appearing on the Site’s graphical interface, as well as all components and content of the Site, whether registered or not, are and shall remain the exclusive property of Château Montrose worldwide or of any third party that has granted it a license.
Therefore, any reproduction, representation, modification, publication or adaptation, in whole or in part, of the elements of the Site, for any purpose and on any medium whatsoever, is prohibited without the prior express written consent of Château Montrose. Any unauthorized use of the Site or any of its elements shall be considered as constituting an infringement in accordance with the provisions of the French Intellectual Property Code. By accessing and browsing the Site, the User acknowledges that the intellectual property rights belong to Château Montrose or to any third party having granted it a license and undertakes not to infringe them in any manner whatsoever, worldwide.
4. Personal data and cookies
Château Montrose complies with all applicable laws and regulations regarding the use of cookies on the Site as well as the protection of personal data, in particular the General Data Protection Regulation (No. 2016/679) and French Law No. 78-87 of January 6, 1978 relating to data processing, files and freedoms. A cookie does not allow the User to be identified but records information relating to the browsing of their computer on the Site. The data obtained is intended to facilitate subsequent navigation on the Site and is also used to measure traffic. Refusing the installation of a cookie may result in the inability to access certain services. However, the User can configure their computer to refuse the installation of cookies.
5. Hyperlinks
Château Montrose may include hyperlinks on its Site directing to other resources available on the Internet, in particular social networks such as Facebook or Instagram, as well as websites enabling the purchase of its products. However, Château Montrose cannot be held responsible for the content, operation, or terms of use of the sites to which the User may have access via these hyperlinks. Château Montrose reserves the right, at any time, to remove any hyperlink directing to content deemed inappropriate and/or contrary to its principles or values. The creation of hyperlinks to the Château Montrose Site, whether simple or deep, may only be made with the prior written authorization of Château Montrose, which remains free to revoke such authorization at any time. Château Montrose therefore reserves the right to request the immediate removal of any hyperlink, whether simple or deep, pointing to the Site, without having to justify such a request. 6. Liability of Château Montrose
The User acknowledges that Château Montrose shall not be held liable for any indirect and/or unforeseeable damages suffered by the User or any third party resulting from access to and/or browsing of the Site, including in the event of financial or commercial loss, loss of profits, anticipated savings, clientele, data, attractiveness or reputation of the User.
In accordance with Articles 2 and 3 of these Terms of Use, Château Montrose disclaims all liability for any lack of accessibility of the Site or any interruption thereof, as well as for any omission or inaccuracy in the information published on the Site. Contact forms are available to Users. Château Montrose reserves the right to remove, without prior notice, any content posted in this space that would violate applicable French law, in particular provisions relating to data protection. Where applicable, Château Montrose also reserves the right to hold the User civilly and/or criminally liable, particularly in the event of messages of a racist, insulting, defamatory, or pornographic nature, regardless of the medium used (text, photograph, etc.).
7. Applicable law and jurisdiction
These Terms of Use are governed by and interpreted in accordance with French law, unless mandatory provisions provide otherwise. The courts within the jurisdiction of the Bordeaux Court of Appeal shall have territorial jurisdiction to hear any dispute, including those related to the use of the Site, without prejudice to the User’s right to bring proceedings before the courts of their place of habitual residence or the place where the harmful event occurred, in accordance with applicable rules on jurisdiction conflicts, including the Code of Civil Procedure.
